Case Study: Divorce Papers in Cults, Aberdeen
Challenge
A woman in Aberdeen was seeking to divorce her husband following his conviction and imprisonment for serious fraud offences. He had been running an investment scam that defrauded multiple victims of substantial sums, and whilst she had not been involved in or aware of his criminal activities, the fallout had destroyed their family life.
Assets had been frozen, their home was subject to confiscation proceedings, and she was facing civil claims from his victims despite her innocence. She needed to divorce him urgently to legally separate her finances from his and protect herself from further association with his crimes.
However, serving divorce papers on a prisoner presented unique procedural challenges. He was being held at a prison outside the local area, and prison regulations around service of legal documents required careful navigation. Additionally, there were concerns about whether he would cooperate with the divorce process or might attempt to obstruct it out of spite or to complicate the confiscation proceedings. His last known address before imprisonment had been in the affluent Cults area of Aberdeen, near the picturesque River Dee, but that property was now part of the confiscation investigation.
The petitioner’s solicitor needed to ensure service was completed correctly to avoid any procedural challenges that might delay the divorce whilst financial matters remained unresolved.

Despite his anger at the divorce — which he appeared to view as another person “abandoning” him in his time of trouble — the papers were served in accordance with both legal and prison regulations.
Our operative maintained professional composure throughout his hostile reaction, making clear that the divorce proceedings would continue regardless of his views. Prison staff witnessed the service, providing additional confirmation of compliance with procedures. We obtained written confirmation from the prison that service had been completed, along with our own detailed witness statement and documentation. A copy of the petition was also left with the prison legal services department for the prisoner’s reference.
Result
The divorce papers were served successfully in compliance with both court requirements and prison regulations, preventing any procedural challenges. The respondent filed a defensive acknowledgment of service from prison but did not contest the grounds for divorce, perhaps recognising that his criminal conviction made opposition futile. The decree nisi was granted within six months, and importantly, the legal separation of the petitioner from the respondent’s financial affairs provided her with protection from further civil claims by his fraud victims. The confiscation proceedings against him continued independently of the divorce. The petitioner was able to obtain her decree absolute and begin rebuilding her life, having legally separated herself from a man whose crimes had devastated multiple families including her own. She expressed relief that the technical challenges of serving papers in prison had been handled professionally, allowing the divorce to proceed without delay while she worked to establish her own financial independence.
