Case Study: Court Summons served in Old Basing, Basingstoke
Challenge
A property management company in Basingstoke needed to serve court summons on a residential tenant who had caused significant damage to a rental property and was refusing to engage with their insurance claim or acknowledge liability. The tenant had punched holes in walls during an alcohol-fueled rage, damaged kitchen units, and broken windows, resulting in over £8,000 in repair costs.
After the tenant moved out, the property management company attempted to recover costs through the tenant’s deposit and direct negotiation, but the tenant claimed the damage was “pre-existing” despite photographic evidence from the check-in inventory proving otherwise. With no resolution possible, the property management company filed a County Court claim for damages and needed to serve the court summons to progress the litigation.
The tenant had moved to a property in Old Basing, a historic village just east of Basingstoke near the River Loddon, and was actively avoiding service. Previous attempts to serve the summons by post had been returned marked “not known at this address,” and when process servers attended the property, the tenant watched through windows and simply refused to answer the door. The property management company needed personal service to ensure the court hearing could proceed and to prevent the tenant claiming they’d never been notified of the proceedings.
Action
iSpy Detectives conducted comprehensive surveillance of the Old Basing property to establish the tenant’s genuine residence and identify an opportunity for personal service. Over six days of observation, we confirmed the tenant was definitely living there despite their attempts to return postal service, and we documented their daily patterns. We discovered the tenant was working at a distribution warehouse in Basingstoke and typically left home at 6:30am each weekday morning.
On a planned Tuesday morning, our process server positioned near the property from 6:15am and successfully intercepted the tenant as they left to walk to their car parked on the street. Our operative approached them before they could enter the vehicle, introducing themselves and serving the court summons clearly and professionally. Despite the tenant’s protests that they were “in a hurry” and “didn’t have time for this,” our server explained that the summons had been served, that they were required to respond to the County Court claim within 14 days, and that failure to respond would result in judgment being entered against them in their absence.
The summons was explained thoroughly, with our operative making clear that ignoring court proceedings was not a viable strategy. Body-worn camera footage documented the service and the tenant’s acknowledgement of the documents. We provided comprehensive evidence for the court file including time-stamped photographs, GPS location data, and a detailed witness statement confirming personal service had been completed at the Old Basing address.
Result
The court summons was served successfully with robust evidence that prevented any later claims of non-service. Following service, the tenant initially maintained their denial of responsibility, but when the case proceeded to a court hearing, the photographic evidence from the check-in inventory was overwhelming.
The judge found entirely in favour of the property management company, awarding the full £8,000 damages plus legal costs and interest. The tenant was ordered to pay, and when they failed to do so voluntarily, enforcement proceedings were initiated. The property management company ultimately recovered the majority of the judgment through attachment of earnings.
Our client praised our persistence in achieving personal service on someone who had been deliberately avoiding the process, noting that without our success, the case might have been significantly delayed by non-service issues, and the tenant might have continued to believe they could avoid accountability simply by hiding.
