A process server legally delivers court documents to individuals involved in legal proceedings. Since the law requires in-person notification of court actions rather than electronic or phone communication, process servers play a vital role in the legal system.

We can serve eviction notices to tenants in housing, offices, industrial units, and private land in Middlesbrough

Case Study: Eviction notice served to a tenant in Ormesby, Middlesbrough

Challenge

A housing association in Middlesbrough needed to serve eviction proceedings on a tenant in Ormesby whose property had been identified as a cannabis cultivation site during a police raid. Whilst the tenant was arrested, they were later released without charge as the police couldn’t definitively prove they were responsible for the cultivation—creating a legal grey area where the tenant was claiming innocence whilst the property had clearly been used for illegal activity. The housing association’s tenancy agreement explicitly prohibited illegal activity on the premises, and the property had sustained significant damage from the grow operation including dangerous electrical modifications, removed walls, and extensive water damage to the ceiling below. Insurance coverage was questionable, and the property was uninhabitable in its current state. The housing association needed to regain possession urgently to make the property safe and commence repairs, but the tenant, now living temporarily with relatives, was evading service and claiming victimhood rather than accepting responsibility.

Action

iSpy Detectives deployed a specialist trace operative to locate the tenant who had not returned to the property since the police raid. Through a combination of electoral roll searches, social media intelligence, and local enquiries, we identified that the tenant was staying with their sister in Stockton-on-Tees, approximately seven miles from the original property. Our process server attended the Stockton address multiple times over a one-week period, eventually making contact with the tenant on the sixth attempt. Despite the tenant’s protestations of innocence and initial refusal to engage, our operative remained professional and focused solely on serving the eviction notice without making any judgments about the criminal investigation. We clearly explained that the notice related to the condition of the property and breach of tenancy terms, regardless of any pending criminal proceedings. Service was completed personally with full photographic documentation. We also served at the original property address by affixing the notice to the front door, as the tenant remained registered there despite not residing on the premises. Our comprehensive report included our tracing methodology, evidence of service at both locations, and a detailed statutory declaration.

Result

The eviction notice was served successfully despite the tenant’s attempts to evade service by not returning to the property. Our tracing work ensured there could be no claim of non-service, and our documentation supported the housing association’s possession claim comprehensively. The court granted possession within six weeks, and the housing association was able to secure the property and begin extensive remediation work estimated at over £30,000. The tenant did not defend the proceedings. Our client valued our investigative capabilities and persistence in locating an evasive individual, noting that without successful service, the legal process would have been significantly delayed.

Case Study: Divorce Papers served in Marton, Middlesbrough

Challenge

A man in Middlesbrough needed to serve divorce papers on his wife who had developed severe alcohol dependency during their marriage, leading to the complete breakdown of their relationship. Despite his attempts to support her in seeking treatment, her drinking had escalated to the point where she was unable to care for herself or maintain employment, and her behaviour when intoxicated had become aggressive and unpredictable.

After fifteen years of marriage, during the last three of which her addiction had dominated their lives, he reluctantly accepted that divorce was necessary for both their wellbeing. She had moved out of the matrimonial home and was now living in a flat in the Marton area of Middlesbrough, near Stewart Park, in a state of chaotic lifestyle with minimal furniture and apparent self-neglect. Attempts to serve the divorce papers by post had failed — mail was clearly not being collected or opened.

The petitioner’s solicitor needed personal service but was concerned about the respondent’s vulnerability, her unpredictable behaviour due to intoxication, and the appropriateness of serving legal papers on someone in active addiction. There were genuine concerns about whether service would be valid if she was intoxicated at the time, and whether the approach might trigger a crisis that could endanger her welfare. This required exceptional sensitivity and coordination with support services.

Action

iSpy Detectives approached this case with careful planning and coordination with both the petitioner’s solicitor and local addiction support services. We discussed with the instructing solicitor the legal position on serving someone with addiction issues and established that service would be valid provided the respondent had sufficient capacity to understand the nature of the document, even if their decision-making generally was impaired by addiction.

Our process server conducted surveillance to identify periods when the respondent appeared most stable — we established that she was typically more coherent in the morning before drinking escalated during the day. We coordinated with a local addiction outreach worker (with appropriate consent and confidentiality protocols) who agreed to be available by phone during the service in case crisis intervention was needed.

On a Friday morning, our operative attended the Marton flat at 10:00am and successfully made contact. The respondent appeared sober at that time and, whilst clearly struggling with her circumstances, was able to understand the nature of the divorce petition. Our server explained the papers with clarity and compassion, avoiding any judgment about her addiction whilst ensuring she understood this was a formal legal document. The service was conducted with dignity and respect for her vulnerability.

Our operative also provided information about local support services and left contact details for addiction services with her, recognising that the divorce process might be a crisis point that could motivate engagement with treatment. Comprehensive documentation recorded the service and the respondent’s capacity at the time.

Result

The divorce papers were served successfully with sensitivity to the respondent’s vulnerability and addiction issues. Following service, she did not file any acknowledgment or response within the deadline, and the petitioner proceeded with an application for deemed service. The court accepted our evidence regarding her capacity at the time of service and the validity of the service itself.

The decree nisi was granted, and financial arrangements were minimal as there were few assets to divide. The petitioner obtained his decree absolute within nine months, allowing both parties to legally move forward. Importantly, several weeks after service, the respondent contacted one of the support services that had been signposted to her and entered a residential rehabilitation programme. Whilst the divorce was painful, the formal ending of the marriage appeared to be a turning point that helped her recognise the need for treatment.

The petitioner, whilst saddened by the end of his marriage, expressed relief that the situation had been handled with compassion and that his ex-wife was finally accessing the help she needed. Our client praised our ethical approach to serving someone in crisis and our coordination with support services to prioritise welfare alongside legal compliance.
