The 78-year-old woman was terrified but also deeply conflicted because he was her son and she recognised he was unwell. However, her own health was suffering from the stress, and social services advised that for both their sakes, a non-molestation order was necessary to create boundaries whilst mental health services attempted to engage with him. The order prohibited unannounced visits, required 48 hours’ notice for any contact, and banned aggressive or threatening behaviour.

However, serving the order required exceptional sensitivity — the subject was mentally unwell, potentially unpredictable, and the situation involved a parent seeking protection from her own child.

Action

iSpy Detectives approached this delicate case with careful planning and coordination with mental health crisis teams. We liaised with Surrey Police and the local mental health trust to ensure appropriate support would be available if the service triggered a crisis response.

Our process server, who had prior training in mental health awareness and de-escalation techniques, attended the subject’s Hersham address on a weekday morning when he was most likely to be stable and least likely to be intoxicated or in a heightened paranoid state. We successfully made contact, and our operative took a calm, non-confrontational approach. Result

His mother reported feeling significantly safer whilst maintaining some contact with her son, and over several months, as his mental health improved with treatment, their relationship began to stabilise.

Six months later, the order remained in place but visits were occurring regularly under its terms without incident. Both mother and son had benefited from the boundaries the order created. The instructing solicitor commended our exceptional sensitivity in handling a case that involved mental health crisis, family breakdown, and the need to protect a vulnerable elderly person whilst not criminalising someone who was unwell.
