Case Study: Bankruptcy Petition served in Ince-in-Makerfield, Wigan 

Challenge

A building supplies company in Manchester was owed £62,000 by a building contractor based in Wigan who had ordered substantial materials for a large construction project but had failed to pay any invoices despite the materials being delivered and used. The contractor’s business had subsequently failed, but rather than addressing his debts through proper insolvency procedures, he had simply closed the company and moved on, leaving multiple creditors unpaid.

The building supplies company obtained a judgment against him personally (as he had provided personal guarantees for the company’s debts) and, when this remained unsatisfied, filed a bankruptcy petition. The debtor was now living in Ince-in-Makerfield, a small town just outside Wigan near the Leeds-Liverpool Canal, and was reportedly working in the construction industry again, apparently having learned nothing from his previous business failure.

However, serving the bankruptcy petition proved difficult because he was extremely wary of anyone approaching him, presumably aware that his previous business dealings had left multiple angry creditors. He didn’t answer his door to strangers, immediately became suspicious of unfamiliar vehicles near his property, and had apparently warned neighbours to tell anyone asking for him that he’d moved away. The creditor’s solicitors needed personal service to proceed with the bankruptcy hearing, but standard approaches had failed.

Action

iSpy Detectives recognised this required a tactical approach to serve someone who was hyper-vigilant about creditor contact. Our investigation team conducted discreet surveillance of his Ince-in-Makerfield property without using obvious investigator vehicles that might alert him. Over one week, we established that whilst he was cautious at home, he had continued working in construction and regularly attended building sites across Greater Manchester. Through careful observation, we identified that he was working on a housing development site in Leigh, near Wigan, and attended there most weekdays.

On a planned Thursday afternoon, our process server attended the construction site and successfully identified him working on-site. Our operative approached him during his break time in a way that appeared casual initially, then identified themselves and served the bankruptcy petition before he could react or retreat. Despite his immediate anger and accusations that approaching him at work was “inappropriate” and would “cost him his job,” our server explained calmly that service of legal documents was entirely lawful, that this was formal bankruptcy proceedings requiring his urgent attention, and that the alternative would have been continued attempts at his home which might have caused him more problems with neighbours.

The petition was served with clear explanation of the debt and the consequences of bankruptcy. Body-worn camera footage documented the service, and we provided detailed evidence for the court including our investigation showing his current employment and the confirmation of service on-site.

Result

The bankruptcy petition was served successfully despite the debtor’s vigilance and suspicion of creditor contact. Following service at his workplace, he appeared to recognise that continued evasion was futile. Three days before the bankruptcy hearing, he contacted the creditor’s solicitors proposing a settlement. Using funds raised through family members, he negotiated a reduced settlement of £45,000 in full and final settlement of the debt, allowing the creditor to recover the substantial majority of the debt without the uncertainty and delay of bankruptcy proceedings. The bankruptcy petition was withdrawn by consent. The building supplies company was satisfied with the outcome, having recovered far more than they would likely have obtained through a bankruptcy estate.
