Case Study: Statutory Demand served in Luton Road, Chatham

Challenge

A construction materials supplier in Kent was owed £28,000 by a building contractor based in Chatham who had repeatedly delayed payment despite receiving materials for multiple projects over a six-month period. The contractor had initially been a reliable customer, but payment patterns had deteriorated significantly, with excuses ranging from “cash flow issues” to claims that their own clients hadn’t paid them. After exhausting goodwill and informal payment arrangements that were repeatedly broken, the supplier’s solicitors needed to escalate the matter by serving a statutory demand—the formal legal warning that precedes bankruptcy proceedings if payment isn’t made within 21 days.

The contractor had moved from their business premises in Chatham town centre to a residential address in the Luton area, a district on the western edge of Chatham near the open countryside, and had ceased responding to calls, emails, and letters. Previous attempts to serve the statutory demand by post had been ignored, and the supplier needed personal service to ensure the 21-day deadline would be legally enforceable. Without personal service, any subsequent bankruptcy petition could be challenged on technical grounds. The supplier was determined to recover the debt but wanted to give the contractor one final clear opportunity to pay before initiating full bankruptcy proceedings.

Action

iSpy Detectives conducted thorough investigation to locate the contractor at their Luton address and establish the best approach for service. Our surveillance team observed the property over four days, confirming the contractor was residing there and establishing their daily patterns. We discovered they were continuing to work in the construction industry, leaving each morning around 7:30am with work equipment and returning in early evening.

On a Tuesday evening, our process server positioned near the property and successfully intercepted the contractor as they returned home at 6:15pm, pulling into their driveway. Our operative approached professionally as they exited their vehicle, introducing themselves and serving the statutory demand before the contractor could enter the house. Despite initial resistance and claims they were “too busy” to deal with it right then, our server explained clearly that the statutory demand had been served, that they had 21 days to pay the full amount or face bankruptcy proceedings, and that ignoring this document would have serious consequences for their ability to continue trading.

The demand was explained thoroughly, with emphasis on both the urgency and the finality—this was their last opportunity to resolve the matter voluntarily before formal insolvency action. Body-worn camera footage documented the service and the contractor’s acknowledgement of the document. We provided comprehensive evidence including photographs, GPS-stamped location data, and a detailed witness statement confirming the date and time of personal service, establishing the start of the crucial 21-day period.

Result

The statutory demand was served successfully with watertight evidence of personal service that would support any subsequent bankruptcy petition if payment wasn’t made. The contractor initially maintained their pattern of delay, but as the 21-day deadline approached, they appeared to recognise the seriousness of the situation.

On day 19, they contacted the supplier proposing an immediate payment of £15,000 with the balance over three months on a formal payment plan. The supplier, preferring to recover the debt without expensive bankruptcy proceedings, accepted the proposal. The initial payment was made within 48 hours, and the remaining balance was paid according to schedule over the following months. The supplier recovered their full entitlement without needing to file bankruptcy proceedings.

Our client praised our professional service that had given the contractor unmistakable notice of the consequences whilst providing a clear pathway to resolve the matter, noting that the statutory demand had finally prompted action after months of empty promises and avoidance.
