Case Study: Court Summons served in Stone, Stafford
Challenge
A building contractor in Stafford had completed a house extension project worth £45,000 for a residential customer, but payment had stopped at the halfway point with £22,500 outstanding. The extension had been completed to building regulation standards and signed off by building control, but the customer was now claiming they were “unhappy” with various cosmetic aspects and refusing to pay the balance until these were “rectified.” The contractor attended multiple times to address concerns, but the customer kept identifying new issues in what appeared to be a deliberate strategy to avoid payment. After exhausting goodwill, the contractor filed a County Court claim for the outstanding £22,500 and needed to serve court summons on the customer. The customer had recently moved from their Stafford address (the property where the extension work was completed) to a new house in Stone, a town northwest of Stafford near the Trent and Mersey Canal, and was refusing to provide their new address or respond to correspondence. Through investigation, the contractor discovered the new Stone address but previous attempts to serve the summons there had failed because the customer was now extremely wary of anyone approaching their property and simply wouldn’t answer the door. The contractor needed personal service to progress their court claim before limitation periods became an issue.
Action

We discovered they were working at an office in Stafford town centre and regularly attended a gym near their Stone home on Tuesday and Thursday evenings.
On a planned Thursday evening, our process server positioned at the gym car park and successfully identified the customer arriving at 6:35pm. Our operative approached them as they walked from their car towards the gym entrance, introducing themselves and serving the court summons before they could retreat to their vehicle or enter the gym.
