Case Study: Court Injunction served in Netherton, Dudley

Challenge

A property developer in Dudley obtained an injunction against protestors who were obstructing access to a brownfield development site in the Netherton area, near St Andrew’s Church. The development, which had full planning permission, was being opposed by a small but vocal group who claimed the land should remain as unofficial green space despite years of contamination from its former industrial use. The protestors had established a semi-permanent camp at the site entrance, were physically blocking construction vehicles, and had chained themselves to the site gates on two occasions, causing significant delays and costs. The developer obtained an injunction requiring the protestors to vacate the site and cease obstructing access, but serving the order proved challenging. The protest group appeared to have no formal organisation or leadership structure, with different individuals present on different days. Some gave only first names, others refused to identify themselves at all, and several wore face coverings making photographic identification difficult. The developer’s lawyers needed the injunction served on identifiable individuals to be enforceable, but also required evidence of attempts to serve the wider group to justify the court potentially broadening the order.

Action

iSpy Detectives approached this unusual situation with a carefully planned strategy combining individual service attempts and group notification. Our team conducted surveillance over a week to identify regular protestors and document their activities. We obtained photographs of twelve individuals who were consistently present, including several who appeared to take leadership roles in organising the daily protests. Through careful observation and conversations with site security, we identified five individuals by name and obtained social media profiles for three of them, revealing their full identities and addresses. Our process servers then attended the protest site on multiple occasions, attempting personal service on identified individuals. We successfully served three protestors directly at the site, clearly explaining the injunction and its terms. For protestors who refused to identify themselves or accept service, we employed the legal protocol for service on unnamed defendants, clearly reading the injunction terms aloud in the presence of the group and affixing copies to prominent locations around the protest camp. All attempts were recorded on video, capturing both successful personal service and the group notification process. We additionally traced two of the named organisers to their home addresses in Brierley Hill and Gornalwood and served them there when site service proved impossible due to their temporary absence.

Result

The injunction was served successfully through a combination of personal service on identifiable individuals and documented attempts to serve the wider group. When the case returned to court, our video evidence and detailed witness statements demonstrated that every reasonable effort had been made to notify all protestors of the order’s terms. The judge extended the injunction to cover unnamed individuals and gave clear warnings about contempt of court. Following service, the protest gradually dissipated—the most active members ceased attending once they understood the legal consequences, and the remaining protestors lacked the organisation to maintain the camp. Construction access was restored within two weeks, allowing the development to proceed.
