Case Study 9: Court Summons in Huddersfield (Serving Holmfirth Area)
Challenge
A commercial printing company in Huddersfield had completed a large print run of promotional materials for a business client, costing £11,000, but the client had refused to pay claiming the print quality didn’t meet their expectations, despite the work matching the approved proof and meeting industry standards.
The printing company suspected the client’s business had encountered financial difficulties and they were using quality complaints to avoid payment for materials they’d already used in their marketing campaign. After attempting to address concerns and offering minor corrections that the client refused to accept, the printing company filed a County Court claim for the outstanding £11,000. The client’s business was registered in Huddersfield town centre, but the director was living in a property in Holmfirth, a picturesque town in the Pennine hills southwest of Huddersfield famous for its Last of the Summer Wine filming locations, and was avoiding all contact with the printing company.
Previous attempts to serve court summons at the registered business address had been unsuccessful because the business had actually ceased trading, and service attempts at the Holmfirth residential address had failed because the director was using the property’s location up a steep hill with limited parking to make casual visits difficult. The printing company needed personal service to progress their claim.
Action
iSpy Detectives conducted investigation and surveillance to serve someone living in a location that was physically difficult to access casually. Our team monitored the Holmfirth property and established that whilst the steep location made the property somewhat isolated, the director regularly left to attend meetings and social events in Holmfirth town centre.
Through monitoring their vehicle movements and social media activity, we identified they regularly attended a business networking breakfast at a hotel in Holmfirth on Wednesday mornings. On a planned Wednesday, our process server attended the hotel and successfully identified the director attending the networking event. Our operative waited until the event concluded and approached the director as they left the hotel, serving the court summons before they could retreat to their vehicle. Despite their embarrassment at being served in front of other business contacts and protests that this was “unprofessional,” our server remained calm and factual, explaining that they had made normal service impossible through avoidance, that this was formal court notification of the £11,000 claim, and that they had 14 days to respond.
The summons was explained clearly with emphasis on the approved proof evidence. Body-worn camera footage documented the service, and we provided comprehensive evidence for the printing company’s court file.
Result
The court summons was served successfully at a business networking event, making the director’s legal situation apparent to their business peers. Following service, the director filed a defence claiming quality defects, but they failed to provide any expert printing evidence supporting their claims.
At the hearing, the printing company’s approved proof documents, technical quality control reports, and evidence that the client had actually used the printed materials in their campaign proved decisive. The judge found entirely in favour of the printing company, awarding the full £11,000 plus costs. The director was ordered to pay personally, and enforcement proceedings ultimately recovered the debt through an interim charging order on the Holmfirth property.
Our client expressed relief that they could recover costs for work completed to specification and praised our creative approach to achieving service at the networking event when the director’s hillside property location had been used as a defensive barrier against casual service attempts.
