Case Study: Court Summons served in Hanley, Stoke
Challenge
A dental practice in Stoke-on-Trent was pursuing a County Court claim against a former patient who had received extensive cosmetic dental work costing £12,000 but had defaulted on the payment plan after making only three monthly payments totaling £1,200. The patient had signed a clear credit agreement for the cosmetic treatment, which included veneers, whitening, and orthodontic work, but after completing the treatment and enjoying the benefits, had simply stopped paying and ceased responding to the practice’s contact attempts.
The dental practice had initially been understanding about payment difficulties, but after nine months of broken promises and no payment, they filed a court claim for the outstanding balance. They needed to serve the court summons on the patient to progress the litigation. The patient was living in a flat in the Hanley area of Stoke, the city’s commercial centre near the Potteries Museum, and was deliberately avoiding all contact with the dental practice.
Previous attempts to serve the summons by post had been returned, and when the practice manager attempted hand delivery, the patient’s partner had claimed they’d moved away. However, social media activity showed they were definitely still in the area and living at the Hanley address. The dental practice needed personal service to ensure the court proceedings could advance.

We established they were working at a retail store in the Hanley shopping district and typically left home around 8:45am on weekdays.
However, the patient appeared vigilant about unexpected approaches, possibly anticipating creditor contact. We adopted a different strategy: rather than intercepting them leaving home, we identified their workplace and attended during their shift. On a planned Thursday afternoon, our process server attended the retail store and successfully identified the patient working on the shop floor. Our operative waited until the patient was on break and approached them in the staff area (with manager permission), serving the court summons professionally and discreetly.
Despite the patient’s obvious discomfort at being served at work and protests that this was “inappropriate,” our server explained calmly that they had left no alternative by avoiding all other service attempts, that this was a formal County Court summons requiring their response within 14 days, and that ignoring court proceedings would result in judgment being entered against them.
The summons was explained clearly with emphasis on the signed credit agreement evidence. Body-worn camera footage documented the service, and we provided comprehensive evidence for the dental practice’s court file.
Result
The court summons was served successfully at the patient’s workplace, ensuring the court proceedings could advance without delay. Following service, the patient filed an acknowledgement of service and attempted to defend the claim by alleging dissatisfaction with the cosmetic work, but they failed to file evidence supporting this defence within the court deadlines.
The judge struck out their defence and entered judgment for the dental practice for the full amount plus costs and interest. The patient was ordered to pay, and when voluntary payment didn’t materialize, the practice obtained an attachment of earnings order deducting payments directly from the patient’s retail employment wages. The dental practice recovered their debt over time through enforced deductions.
